General Terms and Conditions

(GTC)

1. Conclusion of Contract

A binding contract between the landlord and the guest is concluded upon mutual confirmation by telephone, completed booking, written booking confirmation, or provision of the apartment, including acceptance of these General Terms and Conditions (GTC).

2. Prices and Services

The prices available on the website – www.heimathaus-dengg.at – are base prices. The prices stated in the landlord’s offer and written booking confirmation apply. Price changes resulting from subsequent requests by the guest (e.g. change of apartment or length of stay) require the landlord’s approval. The guest undertakes to pay the booked accommodation and agreed prices in full in accordance with the booking confirmation.

3. Guest & Subletting

Subletting or re-letting to third parties is only permitted with the landlord’s written consent. If a third party has made the booking on behalf of the guest, that third party is jointly and severally liable with the guest to the landlord.

4. Payment Terms

After receipt of the booking confirmation, payment must be made by bank transfer to the specified account in accordance with the booking confirmation. Tourist tax, mobility levy, and other fees must be paid by bank transfer no later than the day of arrival. Credit card payments are not accepted. The total amount is payable without deductions. Individually agreed payment deadlines or required deposits (e.g. for longer stays) are binding once confirmed in writing. The booking confirmation will be sent by email to the email address provided. In the event of late payment or non-payment of a deposit, the landlord is entitled to withdraw from the contract.

5. Cancellation by the Guest

Cancellations are only possible in writing and in accordance with the cancellation conditions stated in the booking confirmation.

A cancellation applies to the entire booked allotment unless the accommodation could be re-let. The burden of proof for re-letting lies with the guest. In the event of early departure or unavoidable, acute departure, no refund will be granted.

Recommendation: Take out travel cancellation insurance to cover possible cancellation costs in the event of illness or unforeseen circumstances (e.g. www.reiseversicherung.de).

6. Cancellation by the Landlord

The landlord is entitled to withdraw from the contract – see payment terms. The landlord may also withdraw if force majeure or other circumstances beyond the landlord’s control make fulfillment of the contract impossible. Furthermore, the landlord may withdraw if there is justified reason to believe that the rental could jeopardize the smooth operation of the business, the safety, or the reputation of the landlord. In the event of withdrawal by the landlord, any deposits paid will be refunded to the guest. There is no entitlement to compensation.

7. Arrival, Departure & House Rules

Arrival is possible from 4:00 p.m. Individual arrival arrangements may be made. Departure must take place by 10:00 a.m. at the latest. A flat fee of €50.00 will be charged for lost or stolen keys. Smoking is not permitted in the apartments. In case of violation, claims for damages (e.g. increased cleaning costs) will be asserted. Smoking is permitted outdoors and on terraces. Pets are only allowed upon prior request and written approval by the landlord; fees may apply. Due to technical compression, images on the website may show color deviations or differences in size and proportions. The guest agrees to this.

8. Complaints & Claims

Complaints and claims must be reported immediately by telephone or in person to the landlord. If the guest fails to notify the landlord, there is no entitlement to rectification, rent reduction, or compensation.

9. Liability

The guest undertakes to treat the apartment with care. The guest or their accompanying persons are liable for any damage caused. Any damage identified on the day of arrival must be reported immediately by telephone or in person to the landlord. By taking possession of the apartment, the guest acknowledges its proper condition and completeness unless defects are reported. The landlord’s liability for property damage is excluded unless caused by intent or gross negligence.

10. Miscellaneous

Claims for damages are excluded.

11. Final Provisions

Deviating agreements or verbal side agreements require written form to be valid and only apply once confirmed in writing by the landlord. Data protection laws are observed and complied with. Should individual provisions of these GTC or the contract be invalid or void, the validity of the remaining provisions shall remain unaffected.
